Introduction

Welcome to Yume! These Terms of Service ("Terms") govern your use of Yume, an iOS habit tracking application.

By downloading, installing, or using Yume, you agree to be bound by these Terms. If you do not agree, do not use Yume.


1. Acceptance of Terms

By using Yume, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

This agreement is between you and Richard Lavigne ("Developer," "we," "us"), and not with Apple Inc. Apple is not responsible for Yume or its content.


2. License to Use

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Yume on any Apple device that you own or control, as permitted by the Apple App Store Terms of Service.

Restrictions

You may NOT:

  • Reverse engineer, decompile, or disassemble Yume
  • Modify, adapt, or create derivative works of Yume
  • Distribute, sell, lease, rent, or sublicense Yume
  • Remove or alter any proprietary notices from Yume
  • Use Yume for any illegal or unauthorized purpose
  • Attempt to circumvent any security features or limitations

Device Requirements

Yume requires iOS 17.0 or later. You are responsible for ensuring your device meets these requirements.


3. Subscriptions and Payments

Yume Premium

Yume offers a premium subscription ("Yume Premium") with additional features. Subscriptions are processed through Apple's App Store.

Subscription Terms

  • Free Trial: If offered, you won't be charged during the trial period. You can cancel anytime before the trial ends to avoid charges.
  • Billing: Subscriptions are billed in advance on a recurring basis (monthly or yearly).
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Price Changes: We may change subscription prices. Existing subscribers will be notified in advance.

Cancellation

You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > [Your Name] > Subscriptions).

Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple according to their refund policy. We cannot process refunds directly.


4. Your Content and Data

Ownership

You retain all rights to your data, including:

  • Habits you create
  • Completion records
  • Daily journal entries ("One line a day")
  • App preferences and settings

Your Responsibility

You are solely responsible for:

  • The content you create within Yume
  • Maintaining backups of important data
  • Ensuring your use complies with applicable laws

iCloud Sync

If you enable iCloud sync, your data is stored in your personal iCloud account. We do not have access to this data. iCloud usage is subject to Apple's iCloud Terms.


5. User Conduct

Acceptable Use

You agree to use Yume only for lawful purposes and in accordance with these Terms.

Prohibited Uses

You may NOT use Yume to:

  • Store or transmit illegal content
  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit viruses, malware, or harmful code

6. Intellectual Property

Ownership

Yume, including all software, code, design, trademarks, icons, and documentation, is owned by the Developer and protected by copyright and other intellectual property laws.

Feedback

If you provide feedback or suggestions about Yume, you grant us a worldwide, royalty-free license to use and incorporate such feedback without compensation.


7. Disclaimers

"AS IS" Basis

YUME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

No Guarantee

We do NOT guarantee that:

  • Yume will be error-free or uninterrupted
  • Defects will be corrected
  • Yume will meet your specific requirements
  • Your data will never be lost

Habit Tracking Disclaimer

Yume is a tool to help you track habits. It is NOT:

  • Medical advice or treatment
  • A substitute for professional health guidance
  • A guarantee of habit formation or behavioral change

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for loss of profits, data, use, or goodwill
  • Our total liability shall not exceed the amount you paid for Yume in the 12 months preceding the claim

SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.


9. Apple-Specific Terms

As required by Apple, you acknowledge and agree that:

  1. Agreement Parties: This agreement is between you and the Developer, not Apple. The Developer is solely responsible for Yume and its content.

  2. Scope of License: The license granted to you is limited to a non-transferable license to use Yume on Apple devices you own or control, as permitted by the App Store Terms of Service.

  3. Maintenance and Support: The Developer, not Apple, is responsible for providing any maintenance and support services for Yume.

  4. Warranty: In the event of any failure of Yume to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to Yume.

  5. Product Claims: The Developer, not Apple, is responsible for addressing any claims relating to Yume, including product liability claims, claims that Yume fails to conform to legal requirements, and consumer protection claims.

  6. Intellectual Property: The Developer, not Apple, is responsible for any claims that Yume infringes a third party's intellectual property rights.

  7. Legal Compliance: You represent that you are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

  8. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

10. Data Loss and Backups

Your Responsibility

You are solely responsible for maintaining backups of your data. We are not responsible for:

  • Loss or corruption of habit data
  • Failed iCloud syncs
  • Data loss due to device issues
  • Any other data loss or corruption

We strongly recommend enabling iCloud backup on your device.


11. Updates and Modifications

Software Updates

We may release updates to Yume at our discretion. Updates may:

  • Add, modify, or remove features
  • Require acceptance of new terms
  • Change system requirements

Changes to Terms

We may modify these Terms at any time. Changes become effective when posted with an updated "Last updated" date. Continued use after changes constitutes acceptance.


12. Termination

By You

You may stop using Yume at any time by:

  • Deleting the app from your device
  • Cancelling your subscription (if applicable)

By Us

We may terminate or suspend your access for violations of these Terms.

Effect of Termination

Upon termination:

  • Your license to use Yume ends immediately
  • Provisions regarding disclaimers, limitations of liability, and intellectual property survive termination

13. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, and expenses arising from:

  • Your use or misuse of Yume
  • Your violation of these Terms
  • Your violation of any rights of another party

14. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.

Consumer Rights

If you are a consumer in the European Union, you benefit from mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer.

Informal Resolution

Before filing a claim, please contact us at contact@richard-lavigne.com to attempt to resolve the dispute informally.

If you are in the European Union, you can also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr


15. General Provisions

Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement regarding Yume.

No Waiver

Our failure to enforce any provision shall not constitute a waiver.

Assignment

You may not assign these Terms without our consent. We may assign them without restriction.

Summary

You CAN:

  • Use Yume for personal habit tracking
  • Sync data across your Apple devices via iCloud
  • Cancel your subscription anytime

You CANNOT:

  • Reverse engineer or modify Yume
  • Use Yume for illegal purposes
  • Redistribute or resell Yume

Important:

  • Yume is provided "as is" without warranties
  • Keep backups of your data
  • Subscriptions are managed through Apple
  • We can modify these terms with notice

Your Rights:

  • Stop using Yume anytime
  • Delete your data anytime
  • Request subscription refunds through Apple

By using Yume, you agree to these Terms of Service.

If you do not agree, please do not use Yume.
